Terms and conditions

Preamble
These Terms and Conditions ("Terms") govern all services offered by Trustiatis LLC, a company registered in New Mexico (United States): 4405 Jager Dr NE, Ste C4-4148, Rio Rancho, NM 87144, USA — info@trustiatis.com — https://trustiatis.com.
Trustiatis designs, deploys and maintains professional and hybrid IT environments, including hosting, managed services, telephony, IoT, cybersecurity, and integrated ERP/CRM software.
These Terms apply to any user (business, institution, individual) accessing a Trustiatis service, on site, online, or via removable media.
Article 1 — Purpose and scope
These Terms define the rights and obligations of the parties regarding use of the digital and IT services provided by Trustiatis LLC, notably:
Trustinstance: managed servers and hosting;
Trustistack: ERP/CRM, business applications, web hosting and professional email;
Trustiaboot: configured, secured portable systems;
Professional VoIP, fax and SMS services;
IoT solutions (SIM/eSIM and associated hardware);
Consulting, DevOps, SOC and cybersecurity.
Article 2 — Definitions
Client / User: any individual or legal entity using a Trustiatis service.
Provider / Partner: a third-party entity contributing to service delivery.
Trustiatis Services: the full set of solutions, platforms and tools provided.
Contract: the set formed by the quote, specific terms and these Terms.
License: the right of use granted on a software or integrated component.
Article 3 — Nature and limits of the services
Trustiatis acts as a technology provider and managed-services integrator, not as a telecommunications operator or a financial services provider.
Services rely on secure, hybrid, multi-provider infrastructure, and are supplied within the limits of industry standards and applicable US and international law.
Trustiatis cannot be held liable for illegal or fraudulent use, or use contrary to the laws of the Client's territory.
Article 4 — Legal compliance (KYC / AML / OFAC / Patriot Act)
4.1 — Identification and compliance
Trustiatis LLC applies US international compliance and anti-money-laundering (AML) rules, as well as the requirements of the USA PATRIOT Act, the Bank Secrecy Act (BSA) and Office of Foreign Assets Control (OFAC) directives. Trustiatis reserves the right to verify Client identity (KYC) before activating a service, to suspend or refuse a service in case of suspected fraud, money laundering, terrorist financing or sanctions evasion, and to report any suspicious transaction or activity to the competent US authorities (FinCEN, OFAC, FBI, DHS) as required by law.
4.2 — Sanctions and restrictions
Trustiatis services cannot be provided to persons or entities on OFAC, EU, UN or other competent authorities' sanctions lists; located in embargoed countries or territories (including Iran, North Korea, Syria, Crimea, Cuba); or using our products for military, terrorist, or unlawful surveillance purposes. Any breach results in immediate and final termination of the contract, without notice or refund, with notification to the competent authorities.
Article 5 — Software licenses and usage rights
5.1 — Proprietary licenses
Certain software, systems and modules used in Trustiatis offers (e.g. Microsoft, Oracle, VMware, Telnyx, AWS) are subject to proprietary licenses. The Client acknowledges these rights remain the exclusive property of their respective owners. Trustiatis holds the necessary authorizations for their deployment and guarantees their use within the defined contractual scope.
5.2 — Open source licenses
Trustiatis also integrates open source components under public licenses such as GNU GPL/LGPL, MIT/BSD, Apache 2.0, MPL, EUPL. Rights to these components remain open, but their integration into a Trustiatis-managed environment implies no assignment or transfer of license to the Client beyond what the original texts provide.
5.3 — Software developed by Trustiatis
Internal tools, scripts, configurations, interfaces or extensions produced by Trustiatis in the course of an engagement are protected under the Copyright Law of the United States (17 U.S.C.). They may not be copied, reproduced or redistributed without written agreement.
Article 6 — Data security and compliance
Trustiatis applies international security standards: ISO/IEC 27001 (security management), SOC 2 Type II, GDPR (EU) for European residents' data, and HIPAA for health data where applicable.
Servers are located in highly secure data centers operated by AWS, Oracle, OVHcloud, Infomaniak, Hostinger and other approved partners. Data is encrypted in transit (TLS 1.3) and at rest (AES-256). Trustiatis does not access client data content except on explicit request or legal requirement.
Article 7 — Liability
Trustiatis is bound only by an obligation of means. The company cannot be held liable for data loss due to inappropriate or external use (malware, phishing, hacking), failures caused by an independent third-party provider, or a Client's breach of their local legal obligations.
Trustiatis's maximum liability is limited to the total amount paid by the Client over the last 3 months for the service concerned.
Article 8 — Consumer protection (B2C)
Individual clients benefit from a 14-day right of withdrawal from the order date, except for orders already placed and non-refundable with our suppliers. In that case, the service is passed directly by Trustiatis to the relevant supplier, and the individual must exercise the right of withdrawal directly with that supplier under applicable law.
Professional (B2B) services remain firm and non-refundable after activation, in accordance with the contracts established.
Article 9 — Jurisdiction and governing law
These Terms are governed by the laws of the State of New Mexico (United States). In the event of a dispute, the parties agree to prior mediation. Absent an amicable agreement, the courts of Bernalillo County (NM, USA) shall have sole jurisdiction.
Article 10 — Technical partners and providers
Trustiatis LLC works with several infrastructure and service providers to ensure the reliability, security and performance of its digital solutions. All these providers are bound by strict confidentiality and data protection agreements, compliant with international regulations (GDPR, Swiss FADP, PIPEDA, US federal and local laws).
Important note: Trustiatis LLC is not liable for failures, interruptions, outages, data loss or security breaches that may occur at these providers. Each client acknowledges that use of their services is at their own risk and subject to each provider's own terms.

Infomaniak Network SA — Rue Eugène-Marziano 25, 1227 Geneva, Switzerland. Hosting, professional email, secure cloud solutions.
Hostinger International Ltd. — Kestučio g. 82, Vilnius 08221, Lithuania. Web hosting, VPS, domain registration and site management.
Proton AG — Werkstrasse 37, CH-3012 Bern, Switzerland. Encrypted email, VPN and secure communications.
Cloudflare, Inc. — 101 Townsend Street, San Francisco, CA 94107, USA. CDN, SSL encryption, DDoS protection, web optimization.
Telnyx, Inc. — 730 South Wells Street, Chicago, IL 60607, USA. VoIP, SMS, IoT connectivity and telecom routing.
Workynet LLC — 4405 Jager Dr NE, Ste C4-4148, Rio Rancho, NM 87144, USA. IT infrastructure, managed services and cloud operations.
Trustiatis ensures that all data hosted or processed through these providers respects the principles of minimization, security and regulatory compliance. Responsibility for each provider's own contractual, technical or legal obligations remains exclusively theirs.
Article 11 — Acceptance
By using Trustiatis services, the Client acknowledges having read, understood and accepted these terms, including the legal compliance clauses, security obligations, and software license restrictions.
